Question: What are the requirements for fall
protection on aerial lifts during construction activities?
Answer: Under subpart L, employers must
ensure that employees tie off at all times when working from an aerial lift
[§1926.453(b)(2)(v)]. Employers must ensure that employees using personal fall
arrest systems while working on aerial lifts at heights six (6) feet or more above
a lower level comply with §1926.502(d) of subpart M, specifically:
Personal fall arrest systems, when stopping a fall,
shall: ... (iii) be rigged such that an employee can neither free fall more
than six (6) feet (1.8 m), nor contact any lower level [§1926.502(d)(16)(iii)].
However, §1926.502(d) does not require employers to
comply with manufacturer's instructions when using personal fall arrest
systems. To cite §1926.502(d)(16)(iii), the facts must show that the personal
fall arrest system would permit a free fall of more than six (6) feet or would
permit contact with a lower level - and not base this conclusion solely on information
provided by the manufacturer.
As has been the Agency's longstanding policy, an
employer may comply with OSHA's fall protection requirements for aerial lifts
in one of three (3) ways:
- Use
of a body belt with a tether anchored to the boom or basket (fall
restraint system)
- Use
of a body harness with a tether (fall restraint system)
- Use
of a body harness with a lanyard (fall arrest system)

Injury Recording Criteria and Work Relatedness
A client's employee working for a construction company is paid
to work from 7:00 a.m. to 12:00 p.m. and 12:30 p.m. to 5:30 p.m. as bound by the
National Maintenance Agreement that applies to craft employees working at this jobsite. At 12:20 p.m. (while off the
clock), the employee exits a restroom and falls awkwardly, causing a deep
laceration which requires sutures to close. Does this case fall within the
exception in Section 1904.5(b)(2)(v) for injuries and illnesses that are solely
the result of employees doing personal tasks (unrelated to their employment) at
the establishment outside of their assigned work hours?
Under 29 CFR Subpart C, "Recordkeeping Forms and Recording
Criteria," an injury must be recorded if it is work-related, is a new
case and meets one (1) or more of the general recording criteria (such as
requiring medical treatment beyond first aid). An injury is presumed to be
work-related if it results from an event occurring in the work environment,
unless an enumerated exception to this geographic presumption applies. Under
Section 1904.5(b)(2)(v), an injury or illness is not work-related if it is
solely the result of an employee doing personal tasks (unrelated to their
employment) at the establishment outside of the employee's assigned working
hours. In your scenario, the exception in Section 1904.5(b)(2)(v) would not
apply because the injury occurred during the employee's normal work schedule
(lunch break). The exception in Section 1904.5(b)(2)(v) only applies if an
injury or illness occurs when the employee is conducting personal tasks while
present in the work environment at a time either before the start of the
normal work schedule, or after the normal work schedule has ended. In other
words, the exception does not apply to injuries and illnesses that occur during
breaks (either formal or informal) in the employee's normal work schedule.
Therefore, the case you describe in your letter is work-related and must be
recorded.
1926.501(b)(1)
"Each employee on a walking/working surface (horizontal and vertical
surface) with an unprotected side or edge which is six (6) feet (1.8 m) or more above
a lower level shall be protected from falling by the use of guardrail systems,
safety net systems or personal fall arrest systems.
1926.501(b)(2)(ii)
Each employee on a walking/working surface six (6) feet (1.8 m) or more above a lower
level where leading edges are under construction, but who is not engaged in the
leading edge work, shall be protected from falling by a guardrail system,
safety net system or personal fall arrest system. If a guardrail system is
chosen to provide the fall protection, and a controlled access zone has already
been established for leading edge work, the control line may be used in lieu of
a guardrail along the edge that parallels the leading edge.
1926.501(b)(15)
"Walking/working surfaces not otherwise addressed." Except as
provided in 1926.500(a)(2) or in 1926.501 (b)(1) through (b)(14), each employee
on a walking/working surface six (6) feet (1.8 m) or more above lower levels shall be
protected from falling by a guardrail system, safety net system or personal
fall arrest system.
